
Important News for Cannabis Members from President Daniel Ross
Dear members in the cannabis industry,
I’m writing to share important news regarding legislation that directly impacts cannabis workers across New Jersey.
New Jersey Senate Bill S-3139 — legislation initiated by UFCW Local 152 in partnership with legislative sponsors — passed final approvals with both houses of the New Jersey Legislature on December 22, 2025 and is heading to the Governor’s desk for signing into law. This bill closes loopholes in New Jersey’s cannabis regulations and ensures clear, enforceable labor protections for cannabis workers.
Current cannabis regulations require employers to enter into Labor Peace Agreements (LPAs) with bona fide labor organizations — a well-intentioned safeguard for workers. However, bad actor employers have exploited gaps in the law by using anti-worker tactics to delay or undermine those agreements when a union seeks to enforce them. S-3139 closes those gaps and ensures workers in the cannabis space are clearly afforded the right to organize regardless of an LPA.
This legislation stems from the experience Local 152 had fighting to help a group of cannabis workers in Cumberland County organize their workplace. While those workers ultimately secured their first union contract, the process was extensively delayed by unnecessary litigation — underscoring the need for stronger legal protections.
Once signed, the law will strengthen worker protections, reinforce organizing rights, and provide clear enforcement through the New Jersey Department of Labor.
